Osun State Governor, Gboyega Oyetola, and the All Progressives Congress (APC) have been granted permission by the Election Petition Tribunal sitting in Osogbo to inspect materials used for the July 16 governorship poll.
Granting the two motion ex parte applications of the plaintiffs, Chairman of the tribunal, Justice Tertsea Kume, ordered that the governor-elect, Ademola Adeleke, be summoned through ‘substitution of service of notice’ while the notice should also be pasted on the notice board of the tribunal.
Speaking on the applications, counsel to Oyetola and APC, Yomi Aliyu (SAN), said every effort made by the court’s bailiff to serve Adeleke failed as security guards at the latter’s house in Ede refused to receive the summon after a call was made to someone in the house.
Aliyu added that the bailiff explained (in an affidavit presented) that his security was threatened during the assignment.
He therefore prayed the tribunal to substitute the notice of service by pasting it on the court notice board.
Mr Oyetola and APC had challenged Adeleke’s victory in the July 16 guber election, joining the Independent National Electoral Commission (INEC) and the Peoples Democratic Party (PDP) as respondents in the suit.
