An Osun State High Court sitting in Osogbo has discharged an accused person, Gideon Aycent, five years after his arraignment for conspiracy and armed robbery.
Aycent was brought before the court on the two counts on December 28, 2015, where the prosecutor told the court that he was a logger who had cut a log of wood with which some armed robbers blocked Iwo-Ikire Road before carrying out their acts.
For the first three years of his trial, the accused person did not have any legal representation after he pleaded not guilty to the charges.
A lawyer, Mr Odunayo Henry, later took over his brief and argued that the evidence given by the prosecution counsel was worthless and insufficient to secure his conviction.
Delivering judgment, Justice Kudirat Akano agreed with the defence counsel and ruled that the prosecution’s case was predicated on mere suspicion.
She therefore discharged and acquitted Aycent.
